These Terms of Service (the "Terms") are a binding agreement between you and Owna, the online used-car marketplace available at owna.ae and any related applications (the "Service"). By creating an account, ticking the acceptance box at signup, or using the Service in any way, you agree to these Terms and to the Privacy Policy. If you do not agree, do not use the Service.
The Service is operated by SkyNex Trading DWC-LLC, a limited liability company licensed in the Dubai World Central free zone, United Arab Emirates (licence no. 14754), during Owna's founding period. "Owna" is a trading brand operated under that licence. References to "Owna", "we", "us", and "our" mean the operator of the Service from time to time. The operator intends to transfer the Service to a dedicated Owna entity once that entity is incorporated. If the Service is transferred to another company or legal entity, that entity automatically becomes the operator under these Terms and your agreement continues unchanged, without any need for you to re-accept. You accept these Terms when you create an account and each time you use the Service. We record the date and time of your acceptance. We may amend these Terms as the Service develops or as the law requires. For material changes we will give reasonable advance notice on the Service or by email. Your continued use of the Service after an amendment takes effect constitutes acceptance of the amended Terms. If you do not accept a change, you must stop using the Service and may delete your account at any time.
The Service is available only to individuals who are at least 18 years old, have full legal capacity, and are located in, or listing a vehicle located in, the United Arab Emirates. By using the Service you represent that you meet these requirements. The Service is intended for private individuals. Car dealers, traders, brokers, and businesses may not use the Service to advertise inventory, and may not pose as private individuals.
Owna is an online venue where private sellers advertise vehicles they own and buyers find and contact them. Owna is not a dealer, broker, auctioneer, agent, insurer, escrow provider, or party to any sale. We do not own, possess, inspect, test, certify, value, price, insure, or deliver any vehicle. We do not hold, transfer, or process funds between users, and we never ask for payment in connection with a sale. Any contract of sale is formed exclusively between the buyer and the seller, and its negotiation, conclusion, performance, and any dispute arising from it are solely between them.
You must provide accurate and current information when registering and keep it up to date. You are responsible for maintaining the confidentiality of your password and for all activity that occurs under your account. Notify us immediately at hello@owna.ae if you suspect unauthorised access. You may hold only one account, and you may not transfer, sell, or share your account with anyone else. We may refuse, suspend, or reclaim account identifiers where required to protect the Service or other users.
We require email confirmation before you can list a vehicle or contact a seller. You may optionally verify your phone number by sending a one-time code from your number to Owna's official WhatsApp account. Badges shown on the Service, including "verified phone" and "AI-checked listing", mean only that a specific, limited check was completed at a point in time. A badge is not an endorsement, a warranty, a certification of a vehicle's condition, history, or legality, or a statement that a user is trustworthy. You must carry out your own checks regardless of any badge.
When you create a listing you confirm that: (a) you own the vehicle or are legally authorised by the owner to sell it; (b) all details, including mileage, condition, accident history, service history, and price, are accurate and complete to the best of your knowledge; (c) all photos show the actual vehicle being sold and are not stock images, screenshots, or images taken from other listings; (d) each listing advertises exactly one vehicle, and you will not duplicate listings for the same vehicle; (e) you are a private individual, not a dealer or trader posing as one; and (f) the listing contains no unlawful, offensive, misleading, or irrelevant content, and no attempt to move contact or payment outside the safeguards the law provides. You must complete any sale in accordance with UAE law, including official transfer of ownership through the RTA or the competent authority of the relevant emirate.
Listings are reviewed before publication and monitored after it. Review is performed by a combination of automated systems, including artificial intelligence models that analyse listing photos and text for consistency and signs of fraud, and human moderators. We may, at our sole discretion and with or without prior notice, decline to publish, edit the presentation of, restrict, or remove any listing or content, and we may keep a listing in review for as long as reasonably necessary. Automated review can make mistakes; a listing that is declined or removed can be corrected and resubmitted, and you may contact us to ask for a human re-check. Moderation decisions do not make Owna responsible for the content of any listing that is published.
All listing content is provided by sellers. Despite the review described above, Owna does not and cannot verify the accuracy, completeness, or legality of any listing, and makes no representation or warranty, express or implied, about any vehicle, its condition, history, mileage, ownership, or fitness for any purpose, or about any user. You rely on listing content at your own risk.
Before paying anything, you must: inspect the vehicle in person or commission an independent professional inspection; verify the seller's identity and the ownership documents, including checking for outstanding loans, fines, or impounds; and complete the transfer of ownership at the RTA or the competent authority of the relevant emirate. Meet in safe, public locations. Never pay a deposit, transfer, or any amount before seeing the vehicle and verifying the documents. Owna never requests payment, never holds funds, and never contacts you to "secure" a car. Anyone claiming otherwise is attempting fraud and should be reported to us and to the authorities.
The Service is currently free for private individuals: listing, browsing, contacting sellers, and messaging cost nothing. We may introduce optional paid services in the future. Any fee will be clearly disclosed before you incur it, will apply only if you actively choose the paid service, and will be introduced with reasonable advance notice. No fee will ever be applied to you retroactively or without your agreement.
You must not: list a vehicle you do not own or are not authorised to sell; post false, misleading, or deceptive content; use photos or text belonging to others without permission; impersonate any person or misrepresent your affiliation; harass, threaten, or abuse other users; send spam or unsolicited promotions; advertise services or goods other than the listed vehicle; manipulate prices or interfere with other users' listings; scrape, harvest, or collect data from the Service by automated means; attempt to bypass verification, moderation, security measures, or access controls; introduce malware or interfere with the operation of the Service; or use the Service for money laundering, fraud, or any activity that violates UAE law. We cooperate with UAE authorities in the investigation of unlawful conduct.
Any signed-in user can report a listing using the report button, and anyone can write to hello@owna.ae. Reports are reviewed by our moderation team. Submitting knowingly false or repeated abusive reports is itself a breach of these Terms.
You retain ownership of the photos, text, and other content you post. By posting content you grant Owna a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, adapt (for example, resizing or cropping images and removing metadata), display, and distribute that content for the purposes of operating, moderating, improving, and promoting the Service, including in Owna's own marketing. The licence ends for future use when you remove the content or delete your account, except that we may retain copies as needed for legal compliance, fraud prevention, and dispute records. You are solely responsible for the content you post and confirm you have all necessary rights to it.
The Service, including the Owna name and logo, software, design, text, and databases, is owned by or licensed to Owna and is protected by intellectual property laws. Except for the limited right to use the Service as intended, no rights are granted to you. You may not copy, modify, reverse engineer, or create derivative works from the Service, or use the Owna name or marks without our prior written consent.
The Service may contain links to third-party websites or services, such as map providers, inspection providers, or government portals. These are provided for convenience only. Owna does not control and is not responsible for third-party content, services, or terms, and linking does not imply endorsement. Your use of any third-party service is at your own risk and subject to that party's terms.
We process personal data in accordance with UAE Federal Decree-Law No. 45 of 2021 on the Protection of Personal Data (the PDPL). Our Privacy Policy, available at owna.ae/privacy, explains what we collect, why, where it is processed (including transfers outside the UAE), how long we keep it, and your rights, including self-service account deletion. The Privacy Policy forms part of these Terms.
The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by UAE law, Owna disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free, that defects will be corrected, or that any listing, user, badge, or verification result is accurate or reliable. Nothing in these Terms limits any right you have under mandatory provisions of UAE law, including Federal Law No. 15 of 2020 on Consumer Protection where it applies.
To the maximum extent permitted by UAE law: (a) Owna and its operator are not liable for any indirect, incidental, special, consequential, or exemplary damages, or for loss of profits, data, goodwill, or opportunity; (b) Owna is not liable for any loss arising from a transaction or interaction between users, the condition, legality, or history of any vehicle, the conduct of any user, or content posted by users; and (c) where liability cannot be excluded, Owna's total aggregate liability for all claims is limited to the greater of the amounts you paid Owna in the twelve months before the claim arose and AED 100. Nothing in these Terms excludes or limits liability for fraud, gross negligence, or any liability that cannot lawfully be excluded or limited under UAE law.
To the extent permitted by law, you agree to indemnify and hold harmless Owna and its operator from claims, damages, losses, and reasonable costs (including legal fees) brought by a third party arising out of your content, your listings, your breach of these Terms, your violation of law, or your transactions with other users, except to the extent caused by Owna's own breach or fault.
You may stop using the Service at any time and may delete your account yourself from your profile page. We may suspend or terminate your account, remove your content, or restrict your access, with or without notice, if we reasonably believe you have breached these Terms or the law, created risk or possible legal exposure for Owna or other users, or if we discontinue the Service. Where practical and lawful, we will tell you the reason and how to remedy it. Sections that by their nature should survive termination (including sections 9, 14, 18, 19, 20, and 24) survive.
If any provision of these Terms is held invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in full force. A failure to enforce any provision is not a waiver of it.
These Terms, together with the Privacy Policy, are the entire agreement between you and Owna regarding the Service and supersede any prior understandings. You may not assign or transfer your rights under these Terms. Owna may assign or novate these Terms, in whole or in part, to a company or other successor entity that continues to operate the Service, without your further consent; your rights under these Terms are not reduced by such a transfer.
These Terms are governed by the federal laws of the United Arab Emirates. Any dispute arising out of or in connection with these Terms or the Service that cannot be resolved amicably is subject to the exclusive jurisdiction of the competent onshore courts of the United Arab Emirates. This clause does not deprive you of any protection granted by mandatory provisions of UAE law.
